Terms of Service
Terms governing HorseListing.net and related services
Effective and last updated: September 28, 2026
Official policy of Horse Listing LLC • HorseListing.net
These Terms of Service (the “Terms”) form a binding agreement between you and Horse Listing LLC (“Horse Listing,” “we,” “us,” or “our”) governing your access to and use of HorseListing.net, our social-media pages, and related services (collectively, the “Services”). Please read them carefully.
BY ACCESSING OR USING THE SERVICES, CREATING AN ACCOUNT, OR SUBMITTING A LISTING, YOU AGREE TO THESE TERMS AND OUR PRIVACY POLICY. IF YOU DO NOT AGREE, DO NOT USE THE SERVICES.
1. Eligibility and authority
You may browse publicly available content without an account. To create an account, publish or manage a listing, contact another user through account-based features, or purchase a paid feature, you must be at least 18 years old and legally able to enter into a binding contract. If the age of majority where you live is higher than 18, you must have reached that age.
If you use the Services for a ranch, breeding program, trainer, sale company, auction, business, or other organization, you represent that you have authority to bind that organization. “You” includes both you and that organization.
2. What Horse Listing provides
Horse Listing provides an online advertising, search, discovery, and promotional platform where users may publish and find profiles for horses, stallions, breeding programs, sales, auctions, and related offerings. Related profiles may be connected—for example, a horse may be connected to its stallion, breeding program, consignor, sale, or auction.
Horse Listing may also help users prepare profiles, promotional graphics, photographs, videos, catalogs, social-media content, or other marketing materials under separately agreed terms. Unless a separate written agreement says otherwise, these Terms apply to those related services as well.
3. Horse Listing is not a party to transactions
Horse Listing is not the owner, seller, buyer, breeder, consignor, auctioneer, broker, agent, veterinarian, trainer, inspector, transporter, lender, payment processor, insurer, or guarantor of any horse or transaction unless we expressly agree otherwise in a separate signed writing.
Users communicate, negotiate, inspect, contract, pay, transfer ownership, arrange transport, and resolve disputes directly with one another or with the identified third-party sale or auction. Horse Listing does not take custody of horses or transaction funds and does not guarantee that a listing, user, pedigree, registration, health statement, performance record, breeding status, genetic result, price, bid, sale result, or other information is accurate, current, lawful, or complete.
4. Accounts
Provide accurate, current, and complete registration and profile information.
Keep your password and account access secure and notify us promptly of suspected unauthorized use.
Do not share, sell, transfer, or impersonate another person’s account.
You are responsible for activity under your account and for keeping your contact information current.
We may require reasonable information to verify identity, authority, ownership, or the legitimacy of a listing.
5. Listing responsibilities
You are solely responsible for every listing and representation you submit. You represent and warrant that:
you own the horse or have the owner’s clear authorization to advertise it, or you are otherwise authorized to publish the program, stallion, sale, or auction profile;
the listing is truthful, current, and not materially misleading, and you will promptly update or remove it when circumstances change;
you have all necessary rights and permissions for submitted names, logos, photographs, video, pedigrees, registration records, genetic results, testimonials, and other content;
you will accurately identify material terms and known facts that a reasonable buyer or mare owner would consider important, consistent with applicable law and accepted industry practice;
the horse is not stolen, fraudulently represented, or offered in violation of a court order, lien, contract, registry rule, sanction, or applicable law; and
you will comply with laws and rules relating to animal welfare, advertising, ownership records, registration, health documentation, veterinary requirements, transportation, import/export, brand inspection, auctions, taxes, and consumer protection.
Horse Listing may request supporting documentation, but any review or verification is limited and does not transfer responsibility from the listing owner to Horse Listing.
6. Buyer and mare-owner responsibilities
You are responsible for your own due diligence before making a purchase, breeding commitment, deposit, bid, or other decision. This includes independently confirming the seller’s identity and authority; inspecting the horse; reviewing registration and ownership records; obtaining appropriate veterinary, soundness, reproductive, genetic, drug, or other examinations; evaluating temperament, training, suitability, and performance claims; reviewing contracts and auction terms; and confirming transport, insurance, taxes, border, and import/export requirements.
Never rely solely on a listing, photograph, video, badge, profile connection, social-media post, or statement by Horse Listing as proof of identity, ownership, soundness, safety, breeding status, legitimacy, or value.
7. Connected profiles and third-party sales
Connections among horse, stallion, breeding-program, sale, and auction profiles are informational. A connection may be submitted by users, based on provided records, or created with permission. It does not mean Horse Listing has independently verified pedigree, ownership, affiliation, consignment status, parentage, or endorsement.
Listings may link to third-party websites, auction platforms, bidding services, social-media pages, payment providers, transporters, or other resources. Third parties control their own services and terms. Horse Listing is not responsible for third-party content, availability, security, conduct, fees, or transactions.
8. User content and license
“User Content” means information, text, photographs, video, audio, logos, documents, links, and other material you submit or authorize us to use. You retain ownership of your User Content.
You grant Horse Listing a nonexclusive, worldwide, royalty-free, sublicensable license to host, store, reproduce, resize, format, display, distribute, and use your User Content as reasonably necessary to operate, improve, secure, and promote the Services and your listings. This includes creating previews, search results, connected profiles, promotional graphics, and posts for Horse Listing’s website, email, and social-media channels.
This license lasts while the User Content is available through the Services and for a reasonable period afterward for backups, legal compliance, fraud prevention, and previously distributed promotional materials. You may request removal of future promotional use, but content already shared, downloaded, archived, or reposted by others may remain outside our control.
9. Feedback
If you provide ideas, suggestions, or feedback about the Services, you allow Horse Listing to use them without restriction or compensation. This does not give us ownership of your listing content or confidential business information.
10. Prohibited conduct
You may not use the Services to:
post fraudulent, deceptive, materially inaccurate, duplicate, unauthorized, unlawful, or expired listings;
misrepresent identity, ownership, pedigree, registration, health, soundness, temperament, performance, breeding status, location, price, affiliation, or sale terms;
harass, threaten, discriminate against, exploit, or defraud another person;
promote animal cruelty, unlawful transport, stolen horses, sham transactions, or unlawful activities;
upload malware, scrape or harvest data, overwhelm the Services, bypass access controls, reverse engineer protected portions, or interfere with normal operation;
copy or commercially exploit another user’s content without permission;
collect personal information for spam, unrelated solicitation, or unlawful purposes; or
use the Services in a way that violates these Terms, another person’s rights, or applicable law.
11. Moderation, reports, and enforcement
Horse Listing may, but is not obligated to, review, edit, refuse, restrict, suspend, unpublish, or remove accounts or content; request verification; issue warnings; preserve evidence; or report suspected unlawful activity. We may act when we believe conduct creates risk, violates these Terms, harms users or animals, infringes rights, or may expose Horse Listing to liability.
Moderation is discretionary and may not identify every problem. You may report suspicious listings, intellectual-property concerns, or safety issues through the contact information in Section 20. In an urgent animal-welfare, fraud, or safety situation, also contact the appropriate local authority.
12. Fees, promotions, and paid services
Some Services may be offered free during launch or promotional periods. “Free” does not guarantee that the same feature will remain free. Horse Listing may introduce fees, commissions, subscriptions, featured placement, advertising, marketing packages, or other paid services in the future.
Before charging you, we will disclose the price and applicable terms and obtain the authorization required by law. Unless stated otherwise at purchase, fees are in U.S. dollars, taxes are your responsibility, and third-party processing terms may apply. Refund and cancellation terms will be presented with the relevant paid service. Horse Listing will not retroactively charge for a service expressly offered to you for free.
13. Communications
You agree to receive service-related electronic communications, such as account, listing, security, moderation, inquiry, and policy notices. Where permitted and with any consent required by law, we may also send promotional communications. You may unsubscribe from marketing messages using the link provided, but you may still receive essential service communications.
14. Intellectual property
The Services, excluding User Content, are owned by Horse Listing LLC or its licensors and are protected by intellectual-property laws. Horse Listing, HorseListing.net, our logos, designs, software, organization, and original content may not be copied or used without permission except as allowed by law or these Terms.
If you believe content infringes your copyright or other rights, send a detailed notice to the contact in Section 20 identifying the protected work, the disputed content and location, your contact information, your good-faith basis, and your authority to submit the notice.
15. Availability and changes
We may modify, suspend, discontinue, or limit any feature or the Services, including search fields, profile connections, storage, promotional support, and free or paid offerings. We do not promise uninterrupted availability, preservation of every listing, a particular search ranking, social-media reach, number of inquiries, sale, breeding outcome, or business result.
16. Disclaimers
TO THE MAXIMUM EXTENT PERMITTED BY LAW, THE SERVICES ARE PROVIDED “AS IS” AND “AS AVAILABLE.” HORSE LISTING DISCLAIMS ALL EXPRESS, IMPLIED, AND STATUTORY WARRANTIES, INCLUDING WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, TITLE, NON-INFRINGEMENT, ACCURACY, SAFETY, AVAILABILITY, AND RESULTS.
HORSES AND EQUESTRIAN ACTIVITIES INVOLVE INHERENT RISKS. HORSE LISTING DOES NOT PROVIDE LEGAL, VETERINARY, MEDICAL, BREEDING, TRAINING, FINANCIAL, INSURANCE, TRANSPORTATION, OR TAX ADVICE. SEEK QUALIFIED PROFESSIONAL ADVICE APPROPRIATE TO YOUR SITUATION.
17. Limitation of liability
TO THE MAXIMUM EXTENT PERMITTED BY LAW, HORSE LISTING LLC AND ITS OWNERS, OFFICERS, EMPLOYEES, CONTRACTORS, AND AFFILIATES WILL NOT BE LIABLE FOR INDIRECT, INCIDENTAL, SPECIAL, EXEMPLARY, PUNITIVE, OR CONSEQUENTIAL DAMAGES; LOST PROFITS, REVENUE, DATA, GOODWILL, OR OPPORTUNITY; PERSONAL INJURY, PROPERTY DAMAGE, ANIMAL INJURY, ILLNESS, DEATH, OR LOSS; OR DAMAGES ARISING FROM A USER, LISTING, TRANSACTION, BREEDING ARRANGEMENT, AUCTION, TRANSPORT, THIRD-PARTY SERVICE, OR UNAUTHORIZED ACCESS.
TO THE MAXIMUM EXTENT PERMITTED BY LAW, OUR TOTAL LIABILITY FOR ALL CLAIMS ARISING FROM OR RELATING TO THE SERVICES WILL NOT EXCEED THE GREATER OF (A) THE AMOUNT YOU PAID HORSE LISTING FOR THE SPECIFIC SERVICE GIVING RISE TO THE CLAIM DURING THE SIX MONTHS BEFORE THE EVENT OR (B) US$100. SOME JURISDICTIONS DO NOT ALLOW CERTAIN LIMITATIONS, SO PART OF THIS SECTION MAY NOT APPLY TO YOU.
18. Indemnification
To the maximum extent permitted by law, you will defend, indemnify, and hold harmless Horse Listing LLC and its owners, officers, employees, contractors, and affiliates from claims, losses, liabilities, damages, judgments, costs, and reasonable attorneys’ fees arising from your User Content; your horse, breeding program, stallion, sale, auction, or transaction; your violation of these Terms or law; or your infringement of another person’s rights. This obligation does not apply to the extent caused by Horse Listing’s own unlawful conduct.
19. Suspension, termination, and surviving terms
You may stop using the Services and request account deletion at any time. We may suspend or terminate access immediately when reasonably necessary to protect users, animals, the Services, or Horse Listing; address suspected fraud or illegality; enforce these Terms; or comply with law. Sections that by their nature should survive—including ownership, licenses already exercised, disclaimers, liability limits, indemnification, disputes, and accrued obligations—will survive termination.
20. Governing law, disputes, and contact
These Terms are governed by the laws of the State of Montana and applicable United States federal law, without regard to conflict-of-law principles. Subject to any non-waivable consumer rights, the state and federal courts serving Fergus County, Montana will have exclusive jurisdiction over disputes arising from these Terms or the Services. Before filing a claim, each party agrees to make a good-faith effort to resolve the dispute by written notice and at least 30 days of informal discussion.
Nothing in these Terms waives rights or remedies that cannot lawfully be waived, including applicable consumer rights in a user’s province, state, or country.

21. Changes to these Terms
We may update these Terms. We will post the revised version with a new “last updated” date and provide additional notice when required by law or when changes are material. Your continued use after the effective date of revised Terms means you accept them; if you do not agree, stop using the Services.
22. General terms
These Terms and the Privacy Policy are the entire agreement regarding the Services unless a separate written agreement applies to a particular service. If a provision is unenforceable, it will be modified only as needed and the remainder will continue. Our failure to enforce a provision is not a waiver. You may not assign these Terms without our written consent; Horse Listing may assign them as part of a reorganization, financing, merger, acquisition, or transfer of the Services. Section headings are for convenience only.
